"A court says the federal government cannot freeze Maine’s funding from the Department of Agriculture.

"This comes after the USDA announced it was freezing Maine’s funding when the state would not comply with federal #TitleIX interpretations.

"Under this new ruling, the court is granting Maine a temporary restraining order, saying the federal government must unfreeze and release federal Department of Agriculture funding back to Maine.

"That includes money for things like #SchoolNutrition and #FoodBank programs.

"The Trump administration cannot freeze or withhold funding while this restraining order is in place, and the two sides will have to meet in court, though a date has not been set.

"Maine Attorney General #AaronFrey says this temporary restraining order confirms the Trump administration did not follow the rule of law when it cut program funds that go to feed school children and vulnerable adults.

" 'This order preserves Maine’s access to certain congressionally appropriated funds by prohibiting an unlawful freeze by the administration,' Frey said. “No one in our constitutional republic is above the law, and we will continue to fight to hold this administration to account.' "

President Trump’s campaign of Executive Orders against law firms and others, including the Executive Order he signed on April 9, 2025 against Susman Godfrey, is a grave threat to this foundational premise of our Republic. The President is abusing the powers of his office to wield the might of the Executive Branch in retaliation against organizations and people that he dislikes. Nothing in our Constitution or laws grants a President such power; to the contrary, the specific provisions and overall design of our Constitution were adopted in large measure to ensure that presidents cannot exercise arbitrary, absolute power in the way that the President seeks to do in these Executive Orders. 2. Unless the Judiciary acts with resolve—now—to repudiate this blatantly unconstitutional Executive Order and the others like it, a dangerous and perhaps irreversible precedent will be set... someday a different president with an entirely different set of policy priorities and personal grievances will sit behind the Resolute Desk.... If President Trump’s Executive Orders are allowed to stand, future presidents will face no constraint when they seek to retaliate against a different set of perceived foes. What for two centuries has been beyond the pale will become the new normal. 3. Put simply, this could be any of us.
